1. Acceptance
By creating an account or using EvoFitness, you agree to these terms. If you do not agree, do not use the service.
2. What the service is
EvoFitness is an organisation and follow-up tool. It records and presents what the professional prescribes and what you perform.
EvoFitness does not provide medical services, does not issue diagnoses and does not replace professional guidance. Workout and nutrition prescriptions are the responsibility of the professional supporting you, not of the platform.
3. Your account
A client account is created and administered by the professional who supports you; a professional account is created by self-registration.
The professional may deactivate a client account. Deactivation blocks access and preserves the recorded history, so that the follow-up can resume later. It deletes nothing.
You are responsible for keeping your password confidential and for everything that happens in your account. Tell us immediately if you suspect unauthorised access.
The data you provide must be truthful — especially measurements and health conditions, on which the safety of the prescription depends.
4. Acceptable use
You may not: access other people’s data, attempt to bypass authentication or usage limits, automate requests at volume, upload unlawful or third-party content without authorisation, or use the platform to provide services on behalf of another person without the required professional credentials.
Accounts that breach these rules may be suspended.
5. Subscriptions and payment
Paid plans exist only for professionals and are purchased through the website, processed by Stripe. Clients pay nothing inside the app.
A subscription renews automatically until cancelled. Cancellation takes effect for the next cycle and keeps access until the end of the period already paid for.
6. Risks of physical activity
Physical activity carries a risk of injury. Consult a physician before starting or changing a training programme, especially if you have a pre-existing condition.
Stop exercising and seek care if you feel pain, dizziness or shortness of breath.
The app must not be used in emergencies. In an emergency, contact local emergency services.
7. Content and ownership
The data you record remains yours. You grant us only the licence necessary to store it and display it to you and to your professional.
The EvoFitness software, brand and design are ours and may not be copied or redistributed.
8. Availability and limitation of liability
We work to keep the service running, but it may be unavailable due to maintenance or failure. We do not guarantee uninterrupted operation.
Our liability is limited to the amount paid for the service in the 12 months preceding the event, to the extent such a limitation is permitted by the applicable law. Nothing in these terms excludes liability that the law does not allow to be excluded.
9. Termination
You may delete your account at any time under Settings → Account. Deletion is irreversible: your identifying data is replaced by meaningless values at that very moment, and neither the data nor the account can be recovered.
Termination is not the same as deactivation (section 3): deactivation is the professional’s, blocks access and preserves history; deletion is yours and cannot be undone. Definitive erasure of the remaining records follows the Privacy Policy.
10. Applicable law and language
These terms are governed by Brazilian law. This English version is provided for convenience; the Portuguese version prevails in case of divergence. Questions: contato@evofitness.com.br.
